According to Article 17 of the Convention, the Conference of the Parties shall develop and approve procedures and institutional mechanisms for determining non-compliance with the provisions of the Convention and for the treatment of Parties found to be in non-compliance. To prepare draft procedures on non-compliance for its consideration, the Conference of Parties established an ad hoc open-ended working group on non-compliance that met in April 2006 and April 2007. It prepared a draft text, that is annexed to decision SC-3/20 of the Conference of the Parties, which is to be the basis for further work on procedures and institutional mechanisms by the Conference of the Parties at its fourth meeting in May 2009.
